EU releases POPS regulations to ban brominated flame retardants

HBCDD is a widely used flame retardant in consumer goods. The EU has recently banned the production, sale and use of six bromo ring twelve alkane (HBCDD). The new regulation has a number of specific exemption requirements and came into effect in March 21, 2016.

POP history


The Stockholm Convention on persistent organic pollutants (POPs) was adopted in May 2001 and came into force in May 2004.This is a global convention aimed at protecting human health and environment by eliminating the use of POP chemicals or limiting the production and use of such chemicals.


In May 2001, the European Union signed the Stockholm convention. The convention was ratified in 2004 and came into force in February 2005. The European Union regulation (EC) No.850/2004 announced this. The regulation has been revised many times, including the limitation of short chain chlorinated paraffin (SCCP) in articles in 2015.


EU regulations on persistent pollutants amendment


In March 2, 2016, the EU promulgated the regulation (EU) No. 2016/293, which amended the No. 850/2004 of the European organic law (EC) formulated by the European Parliament and the Council of Europe, and stipulated the prohibition of the production, delivery and use of HBCDD. There are a number of exemption provisions in the new regulation, including:


HBCDD with non intentionally contaminant in flame retardant parts of substances, mixtures, articles or articles should be less than 100 mg/kg. The deadline for the European Commission's audit is March 22, 2019.


HBCDD authorized by REACH to manufacture foamed polystyrene products. The deadline for this exemption is November 26, 2019.


Under the specified conditions, foamed polystyrene and extruded polystyrene containing HBCDD should be used in building materials.


HBCDD is a polybrominated flame retardant, which is widely used, including but not limited to:


Bean bag cushion filler


Household Electric Appliances


Extruded polystyrene (XPS) and foamed polystyrene (PS-E, EPS) in construction industry


Packaging


Blinds, baby car seats and textile coating auxiliaries in textiles


upholstered furniture


HBCCD is also a highly concerned substance (SVHC) in the authorization list of appendix XIV of the REACH code. The latest application authorization date for this SVHC is February 2014, and the implementation date is August 2015. If the manufacturer wants to use HBCDD in its manufacturing process after the latest application date, it must be approved before it can be used. The authorization application is also applicable to the exemption items in the POP regulations.


The HBCDD content of substances, mixtures or articles not exceeding 100 mg/kg will be effective in March 21, 2016 and should be examined in March 21, 2019. The content of the restriction is summarized in Table 1 below:

The European Commission Regulation (EU) No. 2016/293 revised the POP about the regulation (EC) No. 850/2004 appendix I.
